It's potentially illegal as soon as someone takes notice and disapproves.
Fair use legislation is messy and if whoever holds the copyright wants whatever you're doing gone they will generally get a verdict in their favor.
You make derivative work of your favorite franchise property and it gains any sort of notoriety you may get a cease and desist
from the copyright holder just to keep serving as a precedent that they are defending their brand.
If you don't make any money off it and it isn't widely publicized nobody will give a carp and it'll fly under the radar.
But that doesn't mean it's legal.
