Can someone explain how blender porn is legal.

People that make the porn images/vids don't own the character and most of them aren't the ones that made the character in blender or did the work necessary to get it to blender so how are they able to make money on patreon?

Is it because technically they aren't selling the images/vids and are just asking for donations on patreon which is then viewed as a seperate thing?

porn's an option, also apparently people make good money doing vrchat avatars by commision, though I'm sure it includes some level of mocap based fuckery you'd have to learn in order to do it. You could also sell assets on the unreal/unity marketplace, but I don't know how well it pays. I'd assume it'd pay decently well considering you're basically constantly creating passive income sources, that will generate revenue ad infinitum, but I'd do my research before jumping into that.

any derivative work of an official licence is illegal infringement if you do not have permission from the licenser to produce it, doesn't matter if it is commercialised or not.

technically, the IP holder can take lawful action against those producing/selling derivative work. but generally things like fan art and porn aren't going to receive a cease and desist, only cases that are high profile or create potential competitor risk (such as creating a fan game of a game IP) would be a great risk of lawful action.

Not true in the usa. We have parody laws - see family guy, south park, etc and you can do non commercial derivative work, even for portfolios as well.
